Today, I spoke to a USCI Agent and his supervisor at NSC about my case..
I quizzed them about July 2007 revised visa bulletin etc.

He looked around, checked it for like 10 minutes and said HE DOESN'T HAVE
ANY MEMO. All he said that he has this MEMO which states that July 2007 (original) bulletin ..based on that EB1-3 for all countries are current.

:-) May be NSC approves application :-) as practically NO ONE can stop them..

Again this is based on my call to actual live human being at NSC..


I doubt this very much to be true...in case it is.. USCIS has a big problem in their hands.. they really need to clean up the house.. before the shi** hits the roof..

I am also in the same boat.

I have an earlier approved I-140 from my previous company (PD : 30 Nov 2005). In addition, I also have an approved I-140 from my current company (PD: 27 March 2007). However, my latest I-140 still shows the priority
date of 27 March, 2007. As My old priority date is current, my attorney sent a letter to TSC requesting for recapture of my previous priority date. But, TSC sent a reply back saying that we should contact National
Service Center. HUG..!!

Did any one in the similar situation? How did you resolve?

this is a good find! they need to have 3 year extensions on EAD

They have been talking about this since 2004 - http://www.murthy.com/news/n_extead.html - but nobody has done anything about it as far as I know.

Experts,

My friend got a letter from USCIS saying his H1 B transfer got Denied due to Client Contract / Letter.

1. Is he out of status?
2. He can appeal with proper evidence to show that we have contract..with clients..
3. What si the procedure.. pelase advice

Thanks in advance.

If your previous H1B expired, he is out of status. File the appeal asap. Once the appeal is accepted, he is in status till the final decision is made.

This is my opinion only. Please check with attorney.

Hello,
I was wondering if anyone (preferably a teen, im 15) would like to make a web design site for a part time job (after school or w/e) Im great with flash and ok with photoshop, fireworks, and dreamweaver. Also i would like some1 who is laid back and likes to have fun while working. I wont be paying anybody anything but we will split the earnings of what we do. I am on EAD currently. Priority date is Nov 2004 (EB3).
I just switched to a new employer using AC21. Can I file for my EB2 and then interfile AOS ?.

I understand that we need to file new Labor and I140. What happens at I485 ?. Do we need to revoke the current I485 and then apply for a new one. What will be status at that point and what will happen to the EAD ?.

Please point me to any thread if this has already been discussed.

Yes, you can stay in US as long as your I-485 is pending. In order to work, you need EAD, which you can file at any point of time (even if the previous one gets expired). Please note that you have to wait for the I-765 approval before stating to work on EAD.

They might not necessarily ask you, but its always safe to have the below documents.
In our case, they asked us once and the other time, they did not care.

1. Copies of Passport of both the parents (page with picture and name details)
2. A letter authorizing your in-laws to accompany your daughter.

Get it notarized if you can. If not, send the signed copies.

If you need a format for the letter(nothing fancy, was drafted by myself), let me know, I can dig out the one I used.

Hello Folks,

We should call the new organizations. But in this case people will talk about this issue for a day, maybe two. The one thing that will catch people's attention is we do something OUT of the way!

I support one suggestion put forward by one of our members - Go the Munnabhai way! Send them flowers! Do you guy have any idea what kind of news that will be? If USCIS suddenly receive 1000s of flowers everyday? Granted we will be spending money from our pockets but that is a small price to pay to make our woes known to others!

This is really a cruel joke played by DOS and USCIS! We should not stand by and do nothing!

So, if people are interested... let us start a send a flower a day campaign!

Your Employer is wrong. USCIS won't send I-94 in separate mail.

As per my knowledge, One should not start working unless there is I-94 attached to I-797 Approval Notice.

Your wife need to go out of the US and get it stamped before start working.

At POE, the Immigration Officer will issue the new I-94 with valid H1-B Status.

Again I am not an attorney...

Please talk to attorney for further clarifications.

My wife received her H1 document approval notice yesterday, but her approval notice does not contain I 94.

Employer says they will receive I 94 document seperately and they will mail it.

My question is, Is Employer saying TRUTH
Usually I94 is part of H1 Approval notice, ie bottom part, Do USCIS send out both these documents seperately.

If my wife does not get her I 94 what are her Options
